End User License Agreement

This End User License Agreement ("EULA") is a legal agreement between you and [[LEGAL_ENTITY]] ("Supervision", "we", "us") for the Supervision desktop application and server software, including updates and documentation (the "Software"). By installing or using the Software, you agree to this EULA. This EULA supplements our Terms of Service; for the software license specifically, this EULA governs.

1. License grant

Subject to this EULA, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Software on hardware you own or control, for your internal business or personal purposes, during the early access period. You may run the server and connect the desktop application to it as needed within your organization.

2. Early access and automatic updates

The Software is early access (pre-release) and may contain defects or change significantly. The desktop application includes an automatic update mechanism (built on the Tauri updater) that checks for, downloads, and installs signed updates so you stay on a current build. By using the Software you consent to receiving these updates. Updates are cryptographically signed; the update check contacts our update endpoint but does not transmit your footage or camera data.

3. Restrictions

You must not, and must not permit others to:

  • Reverse engineer, decompile, or disassemble the Software, except to the extent this restriction is prohibited by applicable law or by the license of an open source component it contains.
  • Copy, modify, or create derivative works of the proprietary parts of the Software, except as permitted by the open source licenses described below.
  • Rent, lease, lend, sell, sublicense, or provide the Software as a hosted service to third parties.
  • Remove or alter any proprietary notices, or circumvent the update signing or any technical protection.
  • Use the Software in violation of our Acceptable Use Policy or any law.

4. Ownership

The Software is licensed, not sold. We and our licensors retain all right, title, and interest in and to the proprietary parts of the Software, including all intellectual property rights. All rights not expressly granted are reserved.

5. Open source components

The Software includes third party open source components that are provided under their own licenses, which govern your use of those components and, in case of conflict, take precedence over this EULA for that component. These include, among others:

  • MediaMTX — media server, MIT License.
  • FFmpeg — media processing libraries, licensed under the [[FFMPEG_LICENSE — confirm LGPL v2.1+ or GPL depending on the build flags used]].
  • Additional components listed in [[OSS_NOTICES_LOCATION — link to the full third-party notices / NOTICE file shipped with the build]].

A complete list of open source components and their license texts is provided with the Software. Nothing in this EULA limits your rights under those open source licenses.

6. Self hosting and your data

The Software is self hosted: it runs on your hardware, and your cameras, credentials, recordings, and footage stay on your infrastructure. We do not receive or have access to that data. You are responsible for securing, backing up, and lawfully operating your installation, and for compliance with our Acceptable Use Policy and applicable law.

7. Updates and support

We may provide updates, but we are not obligated to provide any particular update, feature, or support during early access. Updates are subject to this EULA unless accompanied by separate terms.

8. No warranty

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR FREE, OR THAT IT WILL RECORD OR RETAIN ANY PARTICULAR FOOTAGE. YOU ASSUME ALL RISK OF USE.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, FOOTAGE, OR BUSINESS, ARISING FROM OR RELATED TO THE SOFTWARE. OUR TOTAL AGGREGATE LIABILITY WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID FOR THE SOFTWARE (WHICH IS ZERO DURING FREE EARLY ACCESS) OR [[LIABILITY_CAP_AMOUNT]]. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

10. Termination

This EULA applies until terminated. It terminates automatically if you breach it. On termination, you must stop using and remove the Software. Sections that by their nature should survive (ownership, disclaimers, liability limits, and governing law) survive termination.

11. Governing law

This EULA is governed by the laws of [[JURISDICTION]], without regard to conflict of law rules, and the courts of [[JURISDICTION]] will have exclusive jurisdiction, except where prohibited by applicable law.
